Definitions
For the purposes of these documents, the term ‘Person’ shall refer soley to an autonomous, human individual–regardless of citizenship, age, or other criteria–and shall exclude corporations or other non-human entities. The rights of a person shall not be subject to limitation by any exempting or exclusionary criteria.
For the purposes of these documents, the term ‘government’ shall include all agencies, organizations, and entities which operate under the aucpices of governmental jurisdictions. These include–but are not limited to–all public schools, police agencies, bureaucratic agencies, or other agencies deriving significant funding or authority from a governmental body or agency.
Section I Univerality of Application. EHxcept where explicit and immediate cause can be cited–and the criteria of all Sections and Amendments be fully and appropriately satisfied–the rights and restrictions listed in this document shall extend to all persons–citizen or non-citizen, adult or child–in their entirety, and without restriction or qualification, excempting lawful conviction of a felony.
Section II The Rule of Law. No law nor rule shall be enacted except upon the basis of scientific fact or common sense acceptance.
Section III The Abbrogation of Priviledge. No law or rule shall be enacted or enforced which which either restricts or grants rights or privileges based upon a criteria which is not applicable to the People as a whole.
Section IV Freedom of expression is inviolate. The government shall make no law or restriction respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech or expression, or of the press–formal or informal; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. These rights shall not be subject to restrictions as to time or place, nor shall they be curtailed or abridged for any reason.
Section V Privacy is inviolate. The right of all people to be secure in their persons, houses, papers, data, and effects, against unwarranted searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be searched and/or seized. No items or information not obviously and openly in view of the naked eye shall be considered nor allowed as evidence against any person, unless such items or information fall conclusively within the description of a duly-authorized warrant. The collection, uses, and dissemination of personally-identifiable data is prohibited to all entities–private, corporate, or governmental–without the express permission of the individual.
Section VI Burden of proof. In all cases–criminal, civil, or military–the accused shall be considered innocent unless proven guilty beyond a reasonalbe doubt. Under no circumstances shall the right of the Great Writ of Habeus Corpus be suspended or abridged.
Section VII The sanctity of Sovreignty. No power or authority not specifically and explicitly granted within this document shall be assumed by the federal government. No power or authority not specifically and explicitly granted within the Constitutional documents of the Federal Government or the States shall be assumed by either the Federal Government or the States.
Section VIII Prohibition of self-incrimination. No person shall be compelled in any judicial case to be a witness against himself or provide evidence against himself. No person be deprived of life or liberty, without due process of law. No person shall be deprived of property except upon conviction of a felony charge, and only after the failure of the third appeal against said conviction.
Section VIII (a) No private property shall be taken for public use without just compensation at fair market value. No private property shall be taken for public use except upon clear and explicit evidence of benefit to the citizenry as a whole, and approval of a 2/3 majority of voters. Property taken under the auspices of Eminent Domain, and the authority of this article, must reside in perpetuity under the direct administrative and financial control of the government, and may only be used for non-commercial endeavors which are open and free of charge to all persons.
Section IX Ownership of the Self. All physical aspects of a person–including, but not limited to–their body–and all parts thereof–their excretions, and their genetic code, are explicitly and implicitly the sole property of the idividual unless such rights are explicitely granted to another. All aspects of a person shall be considered that person’s property for the purposes of civil and criminal investigation and prosecution. No person shall be required to provide biological or biometric samples or data except when under the authority of a duely authorized warrant.
Section X Familial inclusion. The secular and legal definition of a spouse shall not be restricted based on gender or number. All spousal relationships–heretofore referred to as ‘marriages’–recognized by any state of the union or foreign sovreign nation, shall be recognized by all states of the union, and given full rights and recognitions of the issuing and/or residing State. In cases of despute, the least restrictive legislation of the issuing and residing states shall hold precidence.
Section XI Familial Authority. Unless quantifiable and compelling cause shall be given, the Government shall not interfere with the authority of parents in the raising of their children, nor with a child’s choice to associate or disassociate themselves from their parents. The rights and responsibilities of parentage shall be equally balanced; No requirement of parental responsibilities shall be enforced without the granting of equal parental rights, nor shall any parental rights be granted without eqaual parental responsibilities being enforced. In cases of disputed rights or responsibilities, the desires of the primary person–the child–shall be given authoritative weight. With the exception of criminal cause, no parent–either legal or biological–shall be denied reasonable access to, nor influence over, the raising of their child.
